Terms of Service

Effective Date: July 31, 2026

These Terms of Service govern all purchase contracts between Heritage & Crafte (“we,” “us,” or “Seller”) and customers (“you” or “Buyer”) placing orders through our official website at heritcus.com. By browsing, placing an order, or completing payment, you fully agree to all terms below, together with our Shipping Policy, Return & Refund Policy, and Privacy Policy.

1. Product Classification & Production Rules

We offer two product categories:

All custom pieces are produced strictly according to the specifications you submit, including but not limited to: logos, family mottos, portrait references, inscriptions, sizes, and styles.

Handmade Characteristics Acknowledgment: Tiny carving marks, slight color variations, natural inclusions in colored glass (琉璃), hammer marks, and minor dimensional deviations (within ±10mm) are inherent features of traditional handmade craftsmanship — not product defects. These characteristics do not constitute grounds for return, refund, or compensation claims.

2. Pricing & Shipping Terms

All product prices listed on the website include international shipping costs for the following four delivery regions:

Remote Area Surcharge: Alaska, Hawaii, and other remote areas may incur an additional shipping surcharge. This will be confirmed with you before production begins.

Undeliverable Addresses: We do not ship to P.O. boxes or military addresses (e.g., APO/FPO/DPO).

Import Duties, VAT & Customs Clearance: Under DAP (Delivered at Place) terms, all import duties, VAT, taxes, and customs clearance fees at the destination country shall be fully borne by the Buyer. For shipments to the United States, orders valued under $800 USD are typically exempt from customs duties (de minimis rule), subject to local customs regulations.

3. Order Amendments & Cancellations

Full Cancellation (100% refund) is available only under the following conditions:

• Within 3 business days of payment confirmation, AND

• The artisan has not yet started production

For In-Stock Items: Full cancellation is accepted before the item is dispatched. Once shipped, the order is subject to the terms outlined in our Return & Refund Policy.

Amendments After Production Starts: Once production has commenced, any revision to the design (including pattern, text, logo, or dimensions) will incur a 15% modification fee of the total order value.

Custom Items: Once production has started, cancellations based on personal preference will not be accepted.

4. Payment Security

We accept payments via PayPal and Stripe.

Your full credit card information is processed and stored by our official payment service providers (PayPal/Stripe). Our company never saves complete card numbers, CVV codes, or security credentials on our servers.

The purchase contract takes effect once payment is successfully credited to our account.

5. Delivery Damage & Lost Shipment

To file a damage claim, the Buyer must:

1. Keep all original packaging materials (box, cushioning, etc.)

2. Submit a complete unboxing video showing the sealed package, opening process, and damaged item

3. Submit clear photos of the outer packaging (all sides) and the damaged piece

4. Submit all evidence via email to sales@heritcus.com within 48 hours of delivery

Verified lost or severely damaged parcels are eligible for one of the following two options:

• Full refund, or

• Free remanufacture & complimentary reshipment (subject to the original artisan’s availability)

Claims submitted beyond 48 hours, or submitted without complete unboxing video and packaging photos, will be rejected.

6. Parcel Rejection by Buyer

If you refuse delivery of the parcel, fail to collect it, or decline to pay applicable import duties/taxes for personal reasons, all round-trip international freight costs, customs processing fees, and return expenses will be deducted from any refund amount.

If the total deduction exceeds the order value, we reserve the right to reject the refund application entirely, as the goods have been returned to us at our cost.

7. Address Liability

The Buyer shall take full responsibility for the accuracy of the shipping address provided at checkout.

If an order is returned due to an incorrect or incomplete address provided by you, you will be responsible for all additional reshipping costs (including international freight) to send the item to the corrected address. Orders that are returned and cannot be reshipped may be subject to a refund, minus all incurred shipping costs.

8. Intellectual Property

Our Content: All website images, product photographs, craft descriptions, brand designs, process documentation, and other content belong to Heritage & Crafte. Unauthorized downloading, copying, reproduction, or commercial use without written permission is prohibited.

Your Content: Custom portraits, family mottoes, inscriptions, and other content submitted by the Buyer shall remain your property. However, we reserve the right to use finished product photographs for store display, promotional purposes, and portfolio use — we will seek your consent before doing so.

9. Buyer Content Warranty

You warrant and represent that all materials you submit for customization (including but not limited to portrait photographs, family crests, logos, inscriptions, trademarks, etc.) are lawfully owned by you or that you have obtained proper authorization.

If your submitted content involves the portrait rights, copyrights, trademark rights, or moral rights of third parties, you have obtained valid permission from the relevant rights holders. Should any claim, lawsuit, or dispute arise from third-party rights infringement caused by the content you provide, you shall bear full legal liability independently, and Heritage & Crafte shall not be held jointly liable.

We reserve the right to refuse orders containing the following content:

• Content involving pornography, violence, defamation, or discrimination

• Content involving illegal organizations or unlawful activities

• Any other content that violates public order, good morals, or applicable laws and regulations

10. Website Usage & Fraud Prevention

Users shall not use our website for:

• Fraudulent payments or chargebacks

• Malicious order placement or false claims

• Network attacks, scraping, or unauthorized data extraction

We reserve the right to cancel suspicious orders directly and block related accounts without prior notice.

11. Policy Revisions

We reserve the right to revise these Terms of Service, as well as our Shipping Policy, Return & Refund Policy, and Privacy Policy, without prior individual notification.

Updated clauses take effect immediately once published on our official website. By continuing to access the website or placing new orders after revisions are made, you confirm your acceptance of the updated terms.

12. Governing Law & Dispute Resolution

These terms are governed by the laws of the People’s Republic of China.

Any disputes arising from or relating to these Terms shall first be resolved through friendly negotiation between both parties. If negotiation fails, disputes shall be submitted to the competent court at the Seller’s domicile (Qingdao, Shandong, China) for legal proceedings.
